Terms and conditions
Version of 13 October 2026
These terms apply to the use of BandPage, a service of amphora.interactive, Acaciastraat 11, 3551 BD Utrecht, the Netherlands, registered with the Dutch Chamber of Commerce under number 30157344, VAT number NL001939509B30. Where it says "we" below, we mean amphora.interactive. Where it says "you", we mean you as a user, or the band, artist or organisation on whose behalf you have an account.
1. What these terms are about
These terms are part of every agreement between you and us about BandPage. By creating an account you accept them. Your own purchasing terms do not apply unless we have accepted them in writing.
2. What the service is
BandPage is software you use in your browser to make a page of your own, keep lists of contacts, and write and send newsletters from your own domain. You do not buy software; you get the right to use the service while the agreement runs.
We keep developing the service. Features may be added, changed or removed. If something you rely on goes away, we let you know in advance through the email address of your account.
3. Your account and your page
- You are responsible for what happens under your account and for keeping your login details secret. We offer two-factor authentication and recommend you turn it on.
- An account is personal. If you work on a page with others, invite them with an account of their own instead of sharing your password.
- The owner of a page decides who has access and is responsible for what team members do on that page.
- If you suspect someone else can get into your account, tell us as soon as possible at support@listmailing.nl.
4. Sending newsletters
Good delivery depends on all senders together. That is why these rules apply to everything you send with BandPage:
- You only email people who signed up themselves, or with whom you have a customer relationship in which the law allows emailing without separate consent. You do not use bought, rented, shared or scraped addresses.
- Every newsletter makes clear who the sender is and contains a working unsubscribe link. The service handles unsubscribes automatically. You do not put people who unsubscribed back on your list without a new sign-up.
- You only send from domains and addresses you are allowed to use.
- You do not send misleading senders or subject lines, phishing or malicious software, or anything that breaks the law or the rights of others.
- You are responsible for the content of your newsletters and for choosing who receives them.
We keep track of bounces and complaints. If we see too many complaints or undeliverable addresses, or have a well-founded suspicion of abuse, we may pause sending for your page at once, even in the middle of a send. We let you know and look for a solution together.
We do our best to get every newsletter delivered, but whether a recipient gets it in the inbox, in spam or not at all is ultimately decided by that recipient's mail server. We cannot guarantee it.
5. What else you do not do with the service
- Get around the security, overload the service, or extract data automatically in a way that hinders the service.
- Resell the service or offer it to others as if it were your own, unless we have agreed to that.
- Store or spread unlawful material through your page or your newsletters.
If you break this or the rules in article 4, we may suspend your use. Where reasonable, we first give you the chance to put it right.
6. Plans, credits, prices and payment
You pay per page. The plans, credits and their prices are on our website. Prices are in euros and exclude VAT. We charge VAT as the law requires: Dutch VAT, or reverse charged to you if you are a business elsewhere in the EU with a VAT number the EU confirms.
- Plans run per month or per year, are paid in advance and renew automatically for the same period until you cancel. The monthly email allowance starts again every calendar month; what you do not use in a month lapses.
- Credits are a one-off purchase. They never expire and are only used once your monthly allowance has run out. We do not refund unused credits, except on withdrawal (article 7) or where the law requires it.
- Switching to a bigger plan starts at once; you then pay the difference for the rest of the current period. A smaller plan, or switching between monthly and yearly, starts at the end of the current period.
- Payment goes through our payment provider. If a renewal fails, you keep your plan for 7 more days so you can sort out the payment. After that your page falls back to the free plan.
- Invoices are digital; you find them in your account.
We may change prices. We announce a change at least thirty days in advance through the email address of your account, and it takes effect at the next renewal. If you do not agree, you can cancel before the date the new price would apply.
7. Right of withdrawal for consumers
If you buy as a consumer, so not for a business or profession, you may withdraw from a plan or a purchase of credits within fourteen days of buying, without giving a reason.
At checkout you ask us to start the service right away. If you then withdraw within that period, you pay a proportionate amount: for a plan, the part of the period up to the moment you withdraw; for credits, the credits you have already used. We refund the rest within fourteen days, in the same way you paid.
To withdraw, send an email to support@listmailing.nl with your name, the page and the purchase you withdraw from. You may use the model withdrawal form for this, but you do not have to.
If you buy for a business or profession, there is no right of withdrawal.
8. Term and cancellation
You can cancel a plan at any time in your account. The cancellation takes effect at the end of the current period; until then you keep your plan. We do not refund that period, except on withdrawal. Afterwards your page carries on with the free plan, unless you delete the page.
We may end the agreement with thirty days' notice. If we do so while you are not in default, we refund the part of the prepaid period you can no longer use. In case of serious or repeated abuse we may end it at once.
If you delete a page, its plan stops and we erase the data as described in the privacy statement. Invoices are kept as long as the law requires.
9. Availability and maintenance
We do our best to keep the service available, but we do not guarantee a particular availability percentage unless we agree that separately in writing. The service may be briefly unavailable for maintenance and for rolling out new versions.
10. Your data and content
Your contacts, newsletters and the content of your page remain yours. We only use them to provide the service; we do not sell them, do not email your contacts ourselves and do not use your data to train models. You give us the right to store, show and send your content as far as needed to provide the service.
You can export your contacts yourself at any time. You are responsible for keeping copies of data you cannot do without.
11. Intellectual property
The software, the design and the BandPage name are ours and remain so. If you send us an idea or suggestion, we may use it without paying for it.
12. Liability
Our liability per event is limited to the amount you paid for the service in the twelve months before the event. A series of related events counts as one event.
We are not liable for indirect damage, including lost profit, lost revenue, loss of data and damage because a newsletter arrived late or not at all.
These limits do not apply in case of intent or deliberate recklessness on our part, nor where the law does not allow them for consumers.
13. Force majeure
If we cannot meet our obligations because of something beyond our control, such as an outage at a supplier, a power failure or an attack on the infrastructure, we are not liable for that. If it lasts longer than thirty days, either of us may end the agreement.
14. Changes to these terms
We may change these terms. We announce a change at least thirty days in advance through the email address of your account. If you do not agree, you can cancel before the date it takes effect.
15. Personal data
How we handle personal data is in our privacy statement. For the data of your contacts you are the controller and we are the processor. What we agree about that is in the processing appendix below, which is part of these terms.
16. Applicable law and disputes
Dutch law applies to these terms and to every agreement. Disputes go to the competent court in the Midden-Nederland district, unless the law gives a consumer the right to choose the court of their own place of residence. Come to us first: most things we solve together.
Appendix: data processing agreement
This appendix applies to the personal data of your contacts that you process in BandPage. You are the controller for it, we are the processor.
Subject and duration
We process the personal data only to provide the service to you and following your instructions as you give them in the service: keeping lists, confirming sign-ups, sending newsletters and recording delivery results. The processing lasts as long as the agreement runs.
Types of data and data subjects
It concerns the contacts on your lists: email address, name, subscription status and date, unsubscribe reason, and per newsletter sent the delivery status and, if you turn it on, opens and clicks with browser information and the network part of the IP address. Per-recipient sending data is erased after 180 days.
Security
We take appropriate technical and organisational measures, including encrypted traffic over https, passwords stored only as a hash, two-factor authentication, access per page and per role, and database backups several times a day, kept inside the EU.
Sub-processors
We use the following sub-processors for the data of your contacts:
| Party | For | Where |
|---|---|---|
| Hetzner Online GmbH | Servers the service and the database run on, and the backups | Germany |
| Lettermint B.V. | Sending email and measuring opens and clicks | Netherlands |
| Functional Software, Inc. (Sentry) | Error reports when something breaks, without email or IP addresses | EU (Frankfurt), US company |
If we add or replace a sub-processor, we announce it in advance. If you object within thirty days, you may cancel before the date the change takes effect.
Transfers outside the European Economic Area
The data of your contacts is stored and processed inside the European Economic Area. Sentry is a US company; its error reports are kept in Frankfurt and contain no data of your contacts. To the extent there were a transfer after all, it is covered by the EU-US Data Privacy Framework and standard contractual clauses.
Data breaches
If we discover a security breach involving data of your contacts, we report it without undue delay, with what we know at that moment about the nature of the breach, the data involved and the measures we take.
Help with data subject rights
If a contact wants access, correction or erasure, you can handle that in the service yourself; where needed we help. If such a request reaches us directly, we forward it to you and do not answer it ourselves.
Return and deletion
You can export your contacts at any time. If you delete your page or the agreement ends, we erase the data within the period in the privacy statement, unless the law requires us to keep it.
Audits
You may ask us to show that we comply with this appendix. We answer such questions in writing. If you want an on-site audit, we agree in advance when, by whom and at whose cost.
